Pennsylvania and Federal Asbestos Regulations
Pennsylvania has stringent asbestos regulations, such as the Philadelphia Asbestos Control Regulations, which are overseen and enforced by the City of Philadelphia Asbestos Control Unit (ACU). The Asbestos Control Regulations prescribe certain standards and procedures for the removal or enclosure of asbestos and other activities that can disturb or damage the substance.
At the federal level, asbestos is regulated under 29 CFR § 1910.1001, which applies to occupational exposures to asbestos in industries covered by the Occupational Safety and Health Act (OSHA). The following industries are excluded from the regulation but covered under other OSHA standards: construction work, ship repairing, shipbuilding and related occupations.
In addition, 29 CFR § 1910.1001 acknowledges the health hazards associated with asbestos exposure and recognizes mesothelioma, among other conditions, as an asbestos-related disease.
The Environmental Protection Agency (EPA) also regulates the use and disposal of asbestos-containing materials on a federal level. In early 2024, the agency banned the import and use of chrysotile, the only type of asbestos imported for use in the U.S. However, the EPA has not issued a total ban on all types of asbestos or asbestos-containing materials.
